NRI PAN Card Apply Online: Process, Documents, and Why You Need It Before Any Property Transaction

Every NRI planning to buy, sell, or rent property in India needs a Permanent Account Number (PAN) — and the consequences of not having one are punishing. Without a PAN, you cannot register a property. If you are selling, any buyer paying you must deduct penalty TDS of 20% on the full sale amount, not just your profit. That is a cash-flow problem that takes 12 to 18 months to resolve via an income tax refund.

The good news: NRIs can apply for a PAN entirely online from abroad. The process is straightforward if you have the right documents ready.

Why NRIs Cannot Skip the PAN

A PAN is required for virtually every significant financial transaction in India:

  • Property registration: The Sub-Registrar's office requires PAN from both buyer and seller. Registration cannot proceed without it.
  • TDS deduction rates: When an NRI sells property, the buyer deducts TDS under Section 195. If the NRI seller does not have a PAN, the buyer is legally required to deduct at 20% — on the entire gross sale consideration, not just the capital gain. On a ₹1 crore property, that is ₹20 lakh withheld immediately.
  • Income tax filing: To claim refunds of excess TDS, to claim home loan deductions under Section 80C and 24(b), or to apply for a Lower TDS Certificate (Form 128), you must have a PAN and file an Indian income tax return.
  • NRO/NRE account opening: Many banks require a PAN for non-resident account activation.

Applying Online via NSDL

The NSDL (now Protean eGov Technologies) portal is the most widely used route for NRI PAN applications.

Form 49AA is the correct form for individuals who are not Indian citizens (foreign nationals of Indian origin — OCIs, PIOs) or for Indian citizens residing abroad who have a foreign address. Indian citizens with an Indian address use Form 49A, but if your current address is abroad, Form 49AA is the appropriate choice for most NRIs.

The online application process:

  1. Go to the NSDL PAN portal (onlineservices.nsdl.com) and select "New PAN — Foreign Citizens" or use Form 49AA for NRIs
  2. Fill in personal details: full name as on passport, date of birth, citizenship status, contact details, overseas address
  3. Upload scanned copies of required documents (see list below)
  4. Pay the application fee — ₹107 for delivery to an Indian address, approximately ₹1,020 for delivery to a foreign address (fees are periodically revised)
  5. Submit. You receive an acknowledgment number for tracking.

The UTIITSL portal (utiitsl.com) offers an identical alternative application route if you prefer their interface.

Documents Required for NRI PAN Application

Proof of identity (one of the following):

  • Copy of passport (most common — shows nationality and date of birth clearly)
  • OCI card / PIO card

Proof of address (one of the following — must show foreign address):

  • Bank statement from your overseas bank (last 3 months, with address)
  • Overseas utility bill (electricity, water, gas — not older than 3 months)
  • Foreign driving license
  • Overseas voter identity card

All documents must be either:

  • Self-attested by the applicant, or
  • Notarized by a Notary Public in the country of residence, or
  • Attested by the Indian Embassy/Consulate in the country of residence

Unsigned or un-attested documents are rejected. The attestation requirement is often overlooked, causing applications to be returned.

Processing Timeline and Document Submission

After submitting online, the physical signed copy of Form 49AA (printed, signed, and accompanied by physical copies of the supporting documents) must be sent via courier to the NSDL/UTIITSL address in India. The acknowledgment slip generated during the online application must accompany the physical submission.

Processing typically takes 15 to 20 business days from the date the physical documents are received. Delivery to an overseas address takes additional time. Many NRIs opt for delivery to a family member's Indian address for faster receipt, then have it couriered abroad.

Track the application status online using the 15-digit acknowledgment number.

PAN for OCI and PIO Cardholders

OCIs and PIOs follow the same process using Form 49AA. Their OCI or PIO card serves as identity proof. The key difference is the address proof — it must show the foreign residential address, not an Indian address.

Some banks in India have started requiring OCIs and PIOs to link their PAN with their Aadhaar card. As of 2026, Aadhaar linkage is not mandated for NRIs or OCIs without an Indian address in their records, but this space is evolving. Check with your bank for their current requirements.

What to Do if You Already Have a PAN But Cannot Find It

If you held an Indian bank account, filed Indian taxes, or worked in India before emigrating, you likely already have a PAN. Use the PAN Know Your PAN service on the income tax portal (incometaxindia.gov.in) to retrieve it using your name and date of birth.

Once located, ensure the PAN is linked to your current contact details. Outdated mobile numbers or email addresses on PAN records cause issues when filing income tax returns or accessing the e-filing portal.

Timeline: Apply Before You Need It

Apply for a PAN as soon as you know a property transaction is on the horizon — before you start shortlisting properties or entering negotiations. The 15 to 20 business day processing window plus courier time means a rushed PAN application can delay your property registration by a month.
